The Referring Homeowner listed in the attached Agreement agrees not to participate in any negotiations, solicit a buyer, or to solicit any loans between or on behalf of the Seller and/or the Buyer. Referring Homeowner acknowledges that he/she is not a real estate licensee, and a license is required to collect a fee for providing property information, collecting information from a buyer, and/or negotiating a transaction. Referring Homeowner acknowledges that participation in negotiations and/or solicitation of loans disqualifies Referring Homeowner from collection of the referral fee. Referring Homeowner may be in violation of California Business and Professions Code section 10130 et seq. and/or the federal Real Estate Settlement Procedures Act (RESPA) for violation of this provision.

This Agreement for a referral fee may not be combined or used in conjunction with any other offer or promotion. This offer is not applicable with any other incentives, promotions, or offers, or in conjunction with an outside real estate agent or broker.

Governing Law and Jurisdiction. The Parties agree that this Agreement shall be governed by the laws of the State of California.

Confidentiality. During the course of this Agreement, it may be necessary for Seller to share proprietary information, including trade secrets, industry knowledge, and other confidential information. Referring Homeowner will not share any of this proprietary information at any time. Referring Homeowner also will not use any of this proprietary information for his/her personal benefit at any time. This section remains in full force and effect even after termination of the Agreement by its natural termination or the early termination by either party

Referral fees may be subject to withholding tax or other forms of taxes in the state and country in which the transaction takes place. Referring Homeowners should be aware of state, country, or local laws with regards to paying referral fees.
